If your site is hosted in Europe of you live in Europe then you have to advise visitors if you are using cookies for anything beyond that necessary for the actual functioning of the site.
Examples of where you can store a cookie even without permission would be a session cookie to allow them to stay logged in as they move between pages on a membership site or a long term cookie to record the fact that they have denied you permission to store any non-essential cookies.
If you live outside Europe and your site is hosted outside Eurpoe then these restrictions do not apply.
