    Copyright Infringment

    Hi, my friends site has become the recent victim of Copyright Infringement, and what he want's to know is what he can do to this site.
    He has already emailed the owner of the site, so could the owner get sued?

    Here's the 2 sites to prove what I mean:

    It looks to me like both sites have copied screenshots from SIMS games.
    Is it the SIMS game that is suing? I'm sort of lost here.

    Doesn't SIMS have their graphics and games copyrighted?


    EDIT:
    I think both of the sites listed above should see this from EA Games:

    I dare your friend to contact EA Games and tell them that someone
    else is violating his Copyrights ... do that and let us know what they say

    Why not just contact the owner of the site?

    You could sue the owner for copyright infringement, if you weren't violating it yourself. Otherwise you just lose...and should be careful not to get sued yourself.

    By the way, a lot of sites that experience this problem never get it fixed. Why? Many of these clones are offshore, meaning out of jurisdiction. The costs are often far to high to sue, and the likelihood of actually getting anything out of it, or even getting the case to be visited is slim.

    The only thing that could possibly be a copyright violation there is that they both use the same background image, and your friend would have great difficultly in proving to a court that it meets the minimum standard of 'originality' for copyright law to apply.

    To the people saying 'zomg you're violating EA's copyright' - please look up 'fansite kit'. Most games these days provide them and the Sims is no exception.

    Nancy has a good point about the Fan Site Kits ...

    That means both of the sites in the first post could use the same graphics.
    There is also an agreement with the fan kits that EA graphics can't be altered
    or the copyright information removed.

    Wow hang on here, thanks babyjack for posting about my site
    But guys, Im not stealing anything from EA. And EA have seen my site as its been reviewed by a representative for the company before.

    What point is being made is that the site, SmartSims 3 has been copying images from MY SITE. Also hotlinking images from my server!

    The most noticable image being copied from my site is the background image!.

    However the owner of the site has replied with an apology and will hopefully take all images which have been taken from mysite down.

    ALSO: EA put up screenshots and artwork so that fans can use them and get information from them. All sims fansites have screenshots up and EA know this. Theres absolutely no way EA would sue Woohoo Sims!

    ALSO: I haven't used any EA fansite kits! I make my own images and make transparent renders using artwork that they release to us.

    As far as copying an image from a site using a photo editor and using
    it on your own web site ... not much you can do about it except what
    you've already done.

    If they use hotlinks that link directly to your site, contact them and sound all big and fancy with your lawsuit . State that it is content from your site and you will take action unless they take it down.

    (Don't say "Take it down or i hax you", that just doesn't work)
