    Site Logos

    Dont worry, I am not asking for a custom logo . What I want to know is if you design a logo, in any way can you get in trouble if there is another one like it for a buisiness? I designed my own logo for a site I am building called 'Spink', and the logo is made out of an S shape (sort of). It seems like one that another site owner may have thought of already, but goes perfectly with my layout. I did not copy another sites logo, the idea was mine.

    I wouldn't worry about it, but be prepared to change it if the other site requests so.. To avoid any possible legal trouble..I would suspect the other site will never even know, and probably wouldn't care if they did know (Unless it's totally similar)

    I have guess I shouldnt worry about it as much as I am, but I would proptly remove any site logo if asked (and is proven). i really dont think its exactly the same as any other. Thanks for your opinion.

    It boils down to brand recognition. Lets take Apple for example. Their logo is already known, and if you are a hardware salesman, apple may ask you to remove that logo (or any similarities to it). But if you're selling a completely unrelated product, they might let you be. As long as you don't confuse the customers on who you are representing, it shouldn't matter. but for brands such as Disney, who rely HEAVILY on the two ears of Mickey Mouse, may ask ANY company to remove them (they do that to even 7 year old kids who posted Mickey Mouse pictures as a habby earlier on, don't know if they still do that).

    Also, logos can be re-used for different companies. If i'm an advertising company, I can sell my logo which I designed for a company to use, and I can do the same for another company with the same logo. They are paying for the right to use it for their product. They can't sue, cause essentially the advertising company owns it. This is true, unless the company asks the advertising firm for a unique logo ONLY for their company which means they company pays a higher fee, and registers the logo. Not many companies register their logos, unless they want to promote their firm through their logo.

    However, if the logo has the name of the company, and the company name is registered, they may have a point in complaining.

    So as long as the logo doesn't "confuse" the customers, and it doesn't take away customers, and the logo is not registered to another firm, you're fine.
